Experienced Criminal Law Attorney Defends Miami Motorists

Strong representation for DUI, speeding, hit-and-runs, and other traffic offenses in Florida

A wrong move on the busy roadways of Miami can result in more than just steep fines. If you’re charged with driving under the influence or leaving the scene of an accident, your freedom may also be at stake. At Exposito Law, I have more than two decades of experience defending Florida motorists accused of a wide range of traffic violations, including license suspensions, speeding, hit and runs, and DUI. I carefully review the circumstances of your arrest or citation, interview witnesses, and consult with traffic specialists to provide you with a strong defense.

Defending against traffic violations

If not handled properly, traffic violations can cost you a great deal of time and money. In some cases, you may even face jail time and the loss of your license. I help Miami drivers fight many different traffic crimes including:

  • Speeding — Depending on how many miles per hour over the limit you are accused of driving, and the area (school zone, construction zone, etc.), you may be fined hundreds of dollars. Additionally, you will receive points on your driving record, leading to increased insurance premiums.
  • Reckless driving — In Florida, reckless driving is a misdemeanor punishable by up to 90 days in jail and/or $500 in fines.
  • Driving without a license — If you’re accused of driving without a license or on a suspended license, you may be charged with a civil infraction, misdemeanor, even a felony, depending on the facts of the case and whether this is your first offense.

Disobeying the rules of the road in Florida can have serious consequences. I recognize what’s at stake and work decisively to build you a sound defense.

Combatting a DUI charge

If police arrest you for drunk driving, the penalties increase based on prior DUI convictions and whether an accident with injuries resulted. It is important to remember that every subsequent DUI conviction after the first is punishable more harshly — a fourth DUI conviction is categorized as a felony.

To defend my clients accused of DUI in Miami, I may choose to:

  • Challenge the initial traffic stop
  • Contest the accuracy of the field sobriety test
  • Challenge the accuracy of the breathalyzer and chemical test
  • Prove you were not operating the vehicle
  • Show that police violated your Miranda rights

If police accuse you of drunk driving, you can still fight back. I will use my decades of experience to tailor a defense strategy that protects your license, reputation, and freedom.

Fighting charges for leaving the scene of an accident

If you are involved in an auto accident with another person or driver, you must stop your vehicle immediately. Leaving the scene of an accident is a serious crime in Florida that can have life-changing repercussions. If you injure another person with your vehicle and flee the area, you may be charged with a third-degree felony, which is punishable by up to five years in prison.

Should you cause an accident that results in the death of another person and leave the scene, you will be charged with a first-degree felony — a crime penalized by up to 30 years in prison. I can review the evidence against you and determine the best path forward. Depending on your case, the best strategy may be to seek a reduced sentence.

After that about 6 months later my house is invaded by ICE and they tell me I’m under deportation proceedings. because of my prior criminal conduct even though I lived in the US for more than 20 years as a resident. I’m taken to Krome. Mr. Exposito took my case after my parents consulted with other lawyers who said my case was hopeless because of my bad criminal record, They said I would probably get deported. Mr. Exposito looked at the case carefully took the time to interview me and get all of the facts.
